SAN DIEGO DUI LAWYER
DUI Attorney in San Diego
If you're facing a charge for driving under the influence of alcohol or drugs, you need a San Diego attorney trusted by many area residents to defend citizens' rights. While a DUI charge may seem fairly simple to understand, consequences vary in severity based on the number of previous offenses an individual has. The Spiegel Law Group can help you understand the charges against you and the consequences that could come as a result.
Laws Affecting DUI in California
There are several laws regarding driving while under the influence and/or with an alcoholic beverage in the vehicle. Individuals under 21 are not allowed to drive alone with any form of alcoholic beverage, and are also outside of the law if they are found to have a blood alcohol concentration (BAC) of greater than .01, even if the alcohol in their system is a result of prescription drugs or cough syrup. If the driver is younger than 18, any traceable amount of alcohol is an offense.
Any individual over the age of 21 found to be operating a motor vehicle with a BAC of over .08 can be charged with a DUI. Drivers operating a vehicle that requires a commercial driver’s license may not have a BAC exceeding .04. Repeat offenders must maintain a BAC of less than .01 to operate a motor vehicle.
The Possible Consequences of a DUI Charge
Those facing a first time DUI conviction will spend anywhere from 96 hours to six months in jail, and pay up to a $1000 fine. Your license could be suspended for 6 months and an ignition interlock device could be installed in your vehicle to prevent you from driving with a BAC above the limit. You’ll also be required to complete a Driving Under the Influence Program.
A second DUI offense within ten years of the previous offense can be much more serious, resulting in jail time between 90 days and one year. You could have your license suspended for up to two years and will have to again complete a Driving Under the Influence Program.
A third DUI conviction will result in between 120 days and one year of jail time, as well as a three year license suspension. Further, you will be designated as a habitual offender and an ignition interlock device will be required in your vehicle.
Aside from these consequences, the repercussions of a DUI conviction can have lasting effects on your life, including disqualification from employment in some industries and difficulty obtaining insurance.
