- First-time offenders. A first-time offender for a drunk driving conviction can face up to six months in jail and pay up to a $1,000 fine. The individual’s license could also be suspended for up to those same six months. You may also have to take a state mandated driving education class and you could even have a device installed in your vehicle that will prevent you from driving if you are over a certain BAC.
- Second offense. If a person is again convicted of drunk driving within a decade of the first conviction, the defendant can then be sentenced up to one year in prison. Perhaps just as severe, a person can lose their right to drive for up to two years or could again have a device to monitor their BAC installed in their car. Another mandated state education class is also likely.
- Third offense. Those convicted a third time can again spend a year in jail and will have their license suspended for three years. As a repeat offender, you can be forced to use an ignition lock device in your vehicle for a decade.
